A Bill to Legalize Natural Psychedelics Has Been Filed in New York

The bill would reclassify and decriminalize various naturally occurring plant- or fungus-based hallucinogens, such as DMT, ibogaine, mescaline, psilocybin, and psilocin, as well as make their usage lawful.
New York legislators have entered the fray and filed a bill to legalize some natural psychedelics as psychedelic revolution spreads across the US. Cultural normalization and de-stigmatization is well underway across the country, and with that, policy reform is following.
The bill, which was expected to be formally filed for the 2023-2024 legislative session on Wednesday, was unveiled last week by Democratic Assembly members Linda Rosenthal, Jo Anne Simon and Karines Reyes.
Rosenthal has taken a keen interested in psychedelics, and separately introduced a bill last year that would create a “psychedelic research institute” tasked with studying the therapeutic potential of the substances for certain conditions and making policy recommendations.
If this bill is approved, this would be another significant development towards the legalization of psychedelics in the United States. The new measure would legalize the:
“possession, use, cultivation, production, creation, analysis, gifting, exchange, or sharing by or between natural persons of twenty-one years of age or older of a natural plant or fungus-based hallucinogen.”
This proposal would amend current state regulations to provide anyone aged twenty-one or older the freedom to own, use, cultivate, produce, study, distribute, or give away as a gift.
DMT, ibogaine, mescaline, psilocybin and psilocyn would fall under the definition of “natural plant or fungus-based hallucinogens” that would be legalized by the bill.
The proposed law would also allow religious organizations to use entheogens ceremonially and would permit people the freedom to offer or receive psychedelic services for payment or not.
State and local law enforcement would be prohibited from aiding the federal government in enforcing laws relating to banned drugs for activities that are authorized by the state in order to avoid any conflicts of interest.
This measure establishes some interesting and much needed protections:
- Users of naturally occurring plant and fungi-based hallucinogens will not be subject to disciplinary action by their employers or risk losing their credentials.
- The inclusion of natural plant- or fungus-based hallucinogens in behavioural health, drug use disorder, or mental health treatments cannot be rejected on the grounds that these substances are prohibited by federal law.
- Insurance companies are not required to cover expenses related to hallucinogens derived from plants or fungi, nevertheless.
- The law makes it permissible for patients to utilize the aforementioned herbal remedies, and doing so won't make them ineligible for medical care or insurance coverage, nor will they be regarded as illegal.
- Employers would not be allowed to retaliate in any way against a worker who off-duty uses psychedelics legally.
- Local governments in New York are not allowed to adopt laws that make psychedelics illegal under this new law
The introduction of the new measure is an indication that psychedelics reform will advance in 2023, in part because of the advancements achieved by decriminalization campaigns across America and the acceptance of psilocybin treatment among Oregon voters.
Colorado just passed legislation legalizing psilocybin treatment and decriminalizing psychedelics, a ground-breaking achievement that shows the strength of state-level reform.
In California, state Sen. Scott Wiener (D) refiled his own bill to legalize possession of certain psychedelics after his last attempt was knocked down in the 2022 session.
This latest development in NYC would not have been possible without the diligent and brave campaigners who have championed drug policy change across the country.
It is our belief that people should be able explore psychedelics for any reason they choose without having to fight the law (or monopolistic pharmaceutical gatekeepers) to do it, and this bill is one more step towards that future/
