First, it was Denver; now, it's Colorado. The world is changing, and the third wave of psychedelics is here.
On November 11 2022, the people of Colorado voted to legalize psilocybin and psilocin, the two psychoactive components found in magic shrooms.
Prop 122 passed with a narrow win, with 52% of the voters in favor, but in the end, the majority of the votes were in favor of legalization.
Details and limitations
Now that this bill has passed, people 21 years old and above can now use magic mushrooms. They can do so either by themselves or at state-regulated centers with licensed facilitators. No medical approval required.
Can you buy mushrooms in Colorado? No.
You can't sell magic mushrooms in the state. But, with mushrooms legal in Colorado, you can grow magic mushrooms in Colorado as long as you don't sell them.
Other limitations are:
- You can’t use them in school
- You can’t use them while operating a vehicle
- You can’t use them in public spaces.
Other substances affected by this bill are Mescaline, DMT, and Ibogaine. Now you can possess, grow, produce and consume any of them.
This bill will also seal the criminal records of people convicted for possessing these substances.
What people say
Many are happy with the results.
"Over a million people voted yes on this. To think that many people see the value in these medicines, that many people know that these can be used for healing — that's huge," said Veronica Lighting Horse Perez, an NLP practitioner and one of the leading advocates for psilocybin legalization.
On the other hand, some are concerned that companies will lead the legal process instead of scientists.
We also must remember that nearly half of Colorado's population voted against legalization. The population is not yet unanimously in favor. Many consider these substances too dangerous. Yet this is progress after going through a few decades of a fierce war on drugs and propaganda.
Where are magic mushrooms legal?
Magic mushrooms are still illegal on a Federal level, but support is growing for regulatory change.
Two years ago, Oregon became the first state to decriminalize magic mushrooms and Peyote.
There are also some specific cities where Magic mushrooms got decriminalized. For example, San Francisco, Easthampton, Seattle, and Washington.
There are also 19 States where lawmakers introduced bills to decriminalize magic mushrooms but haven't enacted those bills yet.
What about other substances? Where are psychedelics legal in the US? Synthetic substances such as LSD or MDMA are somewhat behind compared to natural psychedelics. There is no state or city in the US where LSD is legalized, for example.
The is still a long road to travel, but things are getting better and better for psychedelic enthusiasts.
Risk and potential
Legalization has the potential for mass healing and growth. It's also a win for bodily autonomy and our right to explore or alter our own consciousness.
Yet, it's important not to let the guard down.
Today, campaigns around harm reduction and safe practices are more important than ever. Good times to do things better than during the hippy era.
